Psychiatry has come up as one of the most dynamic branches of medicine in recent years. There are a lot of controversies regarding concepts, nosology, definitions and treatments in psychiatry, all of which are presently under a strict scanner. Differences are so many that even the meaning of psychiatry varies amongst individual psychiatrists. For us, it is an art to practice psychiatry and give the patient what he needs. Still, it should be practiced with great caution and utmost sincerity towards (...) the patient, based on scientific knowledge and not to be guided by individual conceptions alone. Ethics in psychiatry forms an integral part of its basic concept and meaning, and a tight balance should be maintained between professional advancement and patient benefit. In recent years, the scope of psychiatry has enlarged considerably, with wide ranging influences from Sociology, Anthropology and Philosophy on the one hand, and Neurology and Medicine on the other. Jewish and Christian philosophy existed side by side in the Middle Ages. Both sought the same goal: the explanation of God and His universe. Both utilized the same sources; yet each attained different philosophical and theological systems. The Meditation of the Sad Soul illustrates this divergence between Christian and Jewish thought. Furthermore, since it stands midway between Neo-platonic and Aristotelian Judaism, it underlines the development of key philosophical concepts common to both Judaism and Christianity. Abraham Bar Hayya lived in eleventh (...) century Barcelona, an intellectual center for both Jews and Arabs. The major points of his philosophy blend rabbinical, Neo-platonic and Aristotelian ideas, yet maintain a unique independence of their own. For instance, Abraham cut through the rabbinical and Aristotelian proofs of God, demanding instead a primary positive faith in God's existence. Caught up in the theology of light, he rejected the Platonic idea that darkness was merely an absence of light. Rather, darkness had a force equal to light. Most important, darkness and light were opposites, as were good and evil. God created both. Abraham insists that each had an independent existence in the world. Abraham's thought shows a more "rational" strain which appears later in Christian and even Jewish "heresies." Since good and evil exist as positive forces, man can freely choose his path to salvation. Abraham never gets caught in the Augustinian dilemma of will, grace, and predestination. Further examples of Abraham's independent position crop up in his ideas of creation and time. Creation ex nihilo, of course, but creation in time. Time must have a beginning and, consequently, an end. But man does not have to await passively the Messiah's rectification of sin. Man must repent here on earth and actively lead a good life. He cannot repent after death. How influential was Abraham's tract? The editor calls it a "minor classic" yet does not indicate that it formed a basis for later Christian theology. Maimonides knew it and rejected some of its basic tenets. Still, the book is important since it indicates a striking combination of traditional philosophy subjected to a new critical rationalism, an it foreshadows some of the questions raised by deviant Christian and Jewish theologians.--J. Recently, mainstream philosophy journals have tended to implement more and more stringent forms of peer review, probably in an attempt to prevent editorial decisions that are based on factors other than quality. Against this trend, we propose that journals should relax their standards of acceptance, as well as be less restrictive about whom is to decide what is admitted into the debate. We start by arguing, partly on the basis of the history of peer review in the journal Mind, that (...) past and current peer review practices attest to partisanship with respect to philosophical approach. Then, we explain that such partisanship conflicts with the standard aims of peer review, and that it is both epistemically and morally problematic. This assessment suggests that, if feasible, journals should treat all available and proposed standards of acceptance in philosophy as epistemically equal, and that philosophical work should be evaluated in terms of the novelty and significance of its contribution to developing thought in ways that are of value. Finally, we show, in a programmatic way, that improving the current situation is feasible, and can be done fairly easily. (shrink)

On the analogy of the colloquial register in some modern languages, where narrative and argument may be punctuated by oaths and exclamations (sometimes obscene or blasphemous) in order to maintain a high affective level and compel the hearer's attention, it is reasonable to postulate that Attic conversation also was punctuated by oaths, that this ingredient in comic language was drawn from life, and that the comparative frequency of ║ (|)M M(M) Δ in comedy is sufficiently explained thereby. There are obvious (...) affinities between some passages of comedy, relaxed conversation in Plato and Xenophon, and the forceful, man-to-man tone which Demosthenes sometimes adopts to such good effect (e.g. xxi 209). Compare, for instance, Ar.V.133 f.ἔστιν δ' ⋯νομα ⋮ τῷ μ⋯ν γέροντι ⋮ Φιλοκλέων / να⋯ μ⋯ Δία, τῷ δ' υἱεῖ κτλ., where the oath is a response to imagined incredulity, and X.Smp.4.27αὐτ⋯ν δ⋯ σέ, ἔɸη, ⋯γὼ εἶδον να⋯ μ⋯ τ⋯ν Ἀπόλλω, ὅτε κτλ. Moreover, postponedγάρappears in a segment of conversation constructed in indirect speech by Theophrastus inChar.8.9τ⋯ πρ⋯γμα βο⋯σθαι γάρ(p C N γάρ). Again we must ask: what happened to it afterwards? A couple of cases in Theophrastus' botanical works (CPiii 11.3 andHPiv 6.1) could be a reflex of the influence of comedy on literary language at Athens. The influence was plainly short-lived, since it did not affect the Koine.It is not hard to see why serious poetry in the fifth century and earlier should have experimented occasionally with the postponement ofδέandγάρ: treatment ofM M qas a valid alternative toM q Mis metrically very convenient. No poet, however, could afford to use common words in a bizarre, un-Greek way merely to save himself time and trouble in constructing a verse. Linguistic innovation is normally analogical, proceeding by extension from a starting-point already there, and the most obvious starting-point for postponement ofδέandγάρis constituted by my class (3). This consideration provides comic postponement with a pedigree, but does not deny it individuality. The remarkable scale and frequency with which comedy exploited a phenomenon which tragedy used with restraint and prose hardly at all gives comic postponement the right to be regarded as a quite distinctive artificial feature of comedy. The objectives of this study were to develop a high-density chromosome bin map of homoeologous group 7 in hexaploid wheat, to identify gene distribution in these chromosomes, and to perform comparative studies of wheat with rice and barley. We mapped 2148 loci from 919 EST clones onto group 7 chromosomes of wheat. In the majority of cases the numbers of loci were significantly lower in the centromeric regions and tended to increase in the distal regions. The level of duplicated loci (...) in this group was 24% with most of these loci being localized toward the distal regions. One hundred nineteen EST probes that hybridized to three fragments and mapped to the three group 7 chromosomes were designated landmark probes and were used to construct a consensus homoeologous group 7 map. An additional 49 probes that mapped to 7AS, 7DS, and the ancestral translocated segment involving 7BS also were designated landmarks. Landmark probe orders and comparative maps of wheat, rice, and barley were produced on the basis of corresponding rice BAC/PAC and genetic markers that mapped on chromosomes 6 and 8 of rice. Identification of landmark ESTs and development of consensus maps may provide a framework of conserved coding regions predating the evolution of wheat genomes. (shrink)

Our question is this: What makes an act one of entrapment? We make a standard distinction between legal entrapment, which is carried out by parties acting in their capacities as (or as deputies of) law- enforcement agents, and civil entrapment, which is not. We aim to provide a definition of entrapment that covers both and which, for reasons we explain, does not settle questions of permissibility and culpability. We explain, compare, and contrast two existing definitions of legal entrapment to commit (...) a crime that possess this neutrality. We point out some problems with the extensional correctness of these definitions and propose a new definition that resolves these problems. We then extend our definition to provide a more general definition of entrapment, encompassing both civil and legal cases. Our definition is, we believe, closer to being extensionally correct and will, we hope, provide a clearer basis for future discussions about the ethics of entrapment than do the definitions upon which it improves. This paper explores some key discrepancies between two sets of normative requirements applicable to the research use of personal data and human biological materials: the data protection regime which follows the application of the European Union General Data Protection Regulation, and the Declaration of Helsinki, CIOMS guidelines and other research ethics regulations. One source of this controversy is that the GDPR requires consent to process personal data to be clear, concise, specific and granular, freely given and revocable and therefore has (...) challenged the concept of ‘broad consent’, which has been widely applied in the context of biobanking. Another source of controversy is the interplay between regulations of research ethics and protection of personal data related to the secondary use of personal data and biological materials. In this case, the GDPR ‘research condition’ provides an alternative to re-consent for the use of previously collected personal data and biological materials. Although the mentioned controversies have been raised in the legal literature, they have not been explicitly addressed from the research ethics perspective. Should consent be regarded as a priority legal basis for personal data processing in health data research? Can broad consent still be a suitable legal ground for biobanking? What should be the role of research ethics provisions that differ from the GDPR standards, and what should be the role and function of research ethics committees in the changing environment of health data research? These are the ongoing controversies to be explored in the paper. (shrink)

BACKGROUND: Patient autonomy has gradually replaced physician paternalism as an ethical ideal. However, in a medical context, the principle of individual autonomy has different meanings. More knowledge is needed about what is and should be an appropriate understanding of the concept of patient autonomy in clinical practice. AIM: To challenge the traditional concept of patient autonomy by applying a discourse analysis to the issue. METHOD: A qualitative case study approach with material from one consultation. The discourse is interpreted according to (...) pragmatic and text-linguistic principles and provides the basis of a theoretical discussion of different concepts of patient autonomy. RESULTS: The consultation transcript illustrates how the patient's wishes can be respected in real life. The patient, her husband and the doctor are all involved in the discourse dynamics, governed by the subject matter, namely her mental illness. CONCLUSION: We suggest a dynamic and dialogue-based conception of autonomy as adequate for clinical purposes. These perspectives, based on mutual understanding, take communication between patient and doctor as their starting point. According to this approach, autonomy requires a genuine dialogue, an interpersonal mode of being which we choose to call "authentic interaction". (shrink)

As part of a larger research study, we present model language for disclosing financial interests in clinical research to potential research participants, and we describe the empirical basis and theoretical assumptions used in developing the language. The empirical process for creating appropriate disclosure language resulted in a generic disclosure statement for cases in which no risk to participants’ welfare or the scientific integrity of the research is expected, and nine more specific disclosure statements for cases in which some risk is (...) expected. The disclosure statements are not meant to be canonical, but were instead designed to reflect the typical situations in which disclosure of financial interest might be considered by an institutional review board or conflict of interest committee. Individual institutions could modify key phrases to suit their purposes, and others could use the language in future empirical work on informed consent to better refine the options for disclosing financial interests in clinical research. Medium- and high-spin states of Pr-134 were populated using the Cd-116(Na-23, 5n) reaction and studied with the GAMMASPHERE spectrometer. Several new bands have been found in this nucleus, one of them being linked to the previously observed chiral-candidate twin-band structure. The ground state of Pr-134 could be determined through establishing a level structure that connects the two previously known long-lived isomeric states. Unambiguous spin-parity assignments for the excited states could be performed based on the known 2(-) spin-parity of the ground (...) state combined with the present experimental data. Intrinsic single-particle configurations have been assigned to the newly observed bands on the basis of the measured B(M1)/B(E2) ratios, alignments, band-crossing frequencies, bandhead spins, the observed single-particle configurations in the neighboring nuclei, and taking into account the predictions of total Routhian surface and tilted-axis cranking calculations. Background The emergence of molecular HIV surveillance (MHS) and cluster detection and response (CDR) programs as key features of the United States (US) HIV strategy since 2018 has caused major controversies. HIV surveillance programs that re-use individuals’ routinely collected clinical HIV data do not require consent on the basis that the public benefit of these programs outweighs individuals’ rights to opt out. However, criticisms of MHS/CDR have questioned whether expanded uses of HIV genetic sequence data for prevention reach beyond traditional (...) public health ethics frameworks. This study aimed to explore views on consent within MHS/CDR among critical stakeholders.Methods In 2021 we interviewed 26 US HIV stakeholders who identified as being critical or concerned about the rollout of MHS/CDR. Stakeholders included participants belonging to networks of people living with HIV, other advocates, academics, and public health professionals. This analysis focused on identifying the range of positions among critical and concerned stakeholders on consent affordances, opt-outs, how to best inform people living with HIV about how data about them are used in public health programs, and related ethical issues.Results Participants were broadly supportive of introducing some forms of consent into MHS/CDR. However, they differed on the specifics of implementing consent. While some participants did not support introducing consent affordances, all supported the idea that people living with HIV should be informed about how HIV surveillance and prevention is conducted and how individuals’ data are used.Conclusions MHS/CDR has caused sustained controversy. Among critical stakeholders, consent is generally desirable but contested, although the right for people living with HIV to be informed was centrally supported. In an era of big data-driven public health interventions and routine uses of HIV genetic sequence data in surveillance and prevention, CDC and other agencies should revisit public health ethics frameworks and consider the possibility of consent processes. In a masterly analysis of the Treatise doctrines of sympathy and the indirect passions, Mercer reveals insurmountable difficulties in Hume’s endeavor to give morality a basis in the passions. He characterizes the technical notion of sympathy operating in the Treatise as narrow, egocentric, and amoral; and singles out both a natural (...) proclivity to prejudice and a blindness to value as its inherent limitations. Starting with knowledge and language the author discusses the metaphysical basis of Logic itself and then gets down to the details of propositions, truth functions, definition, negation, and universals. Various modes of inference and induction are also dealt with. 1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

A total of 1918 loci, detected by the hybridization of 938 expressed sequence tag unigenes from 26 Triticeae cDNA libraries, were mapped to wheat homoeologous group 4 chromosomes using a set of deletion, ditelosomic, and nulli-tetrasomic lines. The 1918 EST loci were not distributed uniformly among the three group 4 chromosomes; 41, 28, and 31% mapped to chromosomes 4A, 4B, and 4D, respectively. This pattern is in contrast to the cumulative results of EST mapping in all homoeologous groups, as reported (...) elsewhere, that found the highest proportion of loci mapped to the B genome. Sixty-five percent of these 1918 loci mapped to the long arms of homoeologous group 4 chromosomes, while 35% mapped to the short arms. The distal regions of chromosome arms showed higher numbers of loci than the proximal regions, with the exception of 4DL. This study confirmed the complex structure of chromosome 4A that contains two reciprocal translocations and two inversions, previously identified. An additional inversion in the centromeric region of 4A was revealed. A consensus map for homoeologous group 4 was developed from 119 ESTs unique to group 4. Forty-nine percent of these ESTs were found to be homoologous to sequences on rice chromosome 3, 12% had matches with sequences on other rice chromosomes, and 39% had no matches with rice sequences at all. Limited homology was found between wheat ESTs on homoeologous group 4 and the Arabidopsis genome. Forty-two percent of the homoeologous group 4 ESTs could be classified into functional categories on the basis of blastX searches against all protein databases. (shrink)

Theoretical arguments that psychopathy eliminates individual responsibility for illegal behavior and can therefore serve as a basis for an insanity defense are largely premised on emotional characteristics of psychopathy that impede the individual’s capacity to appreciate right from wrong. We offer arguments and countervailing evidence indicating psychopaths do have the capacity to appreciate right from wrong and therefore should not be absolved of criminal responsibility.

The metacognitive stance of Smith et al. risks ignoring sensory consciousness. Although Smith et al. rightly caution against the tendency to preserve the uniqueness of the human mind at all costs, their reasoned stance is undermined by a selective association of consciousness with high-level cognitive operations. Neurobiological evidence may offer a more general, and hence more inclusive, basis for the systematic study of animal consciousness.

The growth of knowledge and its effects on the practice of medicine have been issues of philosophical and ethical interest for several decades and will remain so for many years to come. The outline of the present volume was conceived nearly three years ago. In 1987, a conference on this theme was held in Maastricht, the Netherlands, on the occasion of the founding of the European Society for Philosophy of Medicine and Health Care (ESPMH). Most of the chapters of this (...) book are derived from papers presented at that meeting, and for the purpose of editing the book Stuart Spicker, Ph. D., joined two founding members of ESPMH, Henk ten Have and Gerrit Kimsma. The three of them successfully brought together a number of interesting contribu tions to the theme, and ESPMH is grateful and proud to have initiated the production of this volume. The Society intends that annual meetings be held in different European countries on a rotating basis and to publish volumes related to these meetings whenever feasible. In 1988, the second conference was held in Aarhus, Denmark on "Values in Medical Decision Making and Resource Allocation in Health Care". In 1989, a meeting was held in Czestochowa, Poland, on "European Traditions in Philosophy of Medicine. From Brentano to Bieganski". We describe evidence that certain inductive phenomena are associated with IQ, that different inductive phenomena emerge at different ages, and that the effects of causal knowledge on induction are decreased under conditions of memory load. On the basis of this evidence we argue that there is more to inductive reasoning than semantic cognition.

Although activated spinal cord glia contribute importantly to neuropathic pain, how nerve injury activates glia remains controversial. It has recently been proposed, on the basis of genetic approaches, that toll-like receptor 4 may be a key receptor for initiating microglial activation following L5 spinal nerve injury. The present studies extend this idea pharmacologically by showing that TLR4 is key for maintaining neuropathic pain following sciatic nerve chronic constriction injury. Established neuropathic pain was reversed by intrathecally delivered TLR4 receptor antagonists derived (...) from lipopolysaccharide. Additionally, -naltrexone, -naloxone, and -naloxone, which we show here to be TLR4 antagonists in vitro on both stably transfected HEK293-TLR4 and microglial cell lines, suppressed neuropathic pain with complete reversal upon chronic infusion. Immunohistochemical analyses of spinal cords following chronic infusion revealed suppression of CCI-induced microglial activation by -naloxone and -naloxone, paralleling reversal of neuropathic pain. Together, these CCI data support the conclusion that neuron-to-glia signaling through TLR4 is important not only for initiating neuropathic pain, as suggested previously, but also for maintaining established neuropathic pain. Furthermore, these studies suggest that the novel TLR4 antagonists -naloxone and -naloxone can each fully reverse established neuropathic pain upon multi-day administration. This finding with -naloxone is of potential clinical relevance. This is because -naloxone is an antagonist that is inactive at the -opioid selective receptors on neurons that produce analgesia. Thus, these data suggest that -opioid antagonists such as -naloxone may be useful clinically to suppress glial activation, yet -opioid agonists suppress pain. (shrink)

Background: The Declaration of Helsinki, the World Medical Association’s statement of ethical guidelines regarding medical research, is published in the three official languages of the WMA: English, French and Spanish.Methods: A detailed comparison of the three official language versions was carried out to determine ways in which they differed and ways in which the wording of the three versions might illuminate the interpretation of the document.Results: There were many minor linguistic differences between the three versions. However, in paragraphs 1, 6, (...) 29, 30 and in the note of clarification to paragraph 29, there were differences that could be considered potentially significant in their ethical relevance.Interpretation: Given the global status of the Declaration of Helsinki and the fact that it is translated from its official versions into many other languages for application to the ethical conduct of research, the differences identified are of concern. It would be best if such differences could be eliminated but, at the very least, a commentary to explain any differences that are unavoidable on the basis of language or culture should accompany the Declaration of Helsinki. This evidence further strengthens the case for international surveillance of medical research ethics as has been proposed by the WMA. (shrink)

The urgency of the research topic lies in the author's search for the elimination of environmental and other threats to the existence of mankind. The population of Homo Sapiens increases quantitatively, intensify the rate of degradation of the natural environment and accelerates the movement to the total Collapse. Scientists in the world create only "appeals" and “warnings” of danger, but even the UN decision and three environmental forums 1992, 2002 and 2012 do not indicate real means of salvation. The purpose (...) of the study is a critical analysis of the works of scientists of the world and their environmental projects and plans. The objectives of the study are to offer a real way of saving humanity through the replacement of industrial technologies with environmentally safe nootechnologies, the development and use of the noosciences. The methodology of the study is based on the authors' foundations of the basis of many new exact and humanitarian noosciences - noophilosophy, nooecology, noohistory, noosociology, noocognitiology, and others. We use the noointegral, systemic and noohistorical methods within the framework of a promising principle of global evolutionism with transdisciplinary approaches. The result of the study is unquestionable evidence that in the flow of nanotechnologies since 2000 ecologically safe appears, which we propose to call "wise" - neotechnologies. Their number is small and the number is growing slowly, but the trends of world science evidenced by the inevitability of the victory of nootechnologies and elimination of all industrial technologies. The main result of the study is the list of noosciences and nootechnologies, which are "terms from the future". They form the Nooglossary for which we received the copyright certificate - a legal document of our author's priority. The conclusion is that humanity will be saved not by the "third industrial revolution" by J. Rifkin and not by the "fourth" K. Schwab or “smart-activity”, but by the development of the nooosciences and the massive use of environmentally safe nootechnologies. Nooera has already begun, but humanity does not notice it yet. We show that if there is a nonconstructible real, then every perfect set has a nonconstructible element, answering a question of K. Prikry. This is a specific instance of a more general theorem giving a sufficient condition on a pair $M\subset N$ of models of set theory implying that every perfect set in N has an element in N which is not in M.

This paper challenges Williamson's "E = K" thesis on the basis of evidential practice. The main point is that most evidence is only approximately true and so cannot be known if knowledge is factive.

Differential scanning calorimetry (DSC) has been employed to investigate the glass transition activation energy E g, thermal stability and glass-forming ability (GFA) of Se90In10− x Sb x (x = 0, 2, 4, 6, 8, 10) chalcogenide glasses. DSC runs were performed at six different heating rates. Well-defined endothermic and exothermic peaks were obtained at glass transition and crystallization temperature. The dependence of glass transition temperature T g on heating rate (α), as well as composition of Sb, has been studied. From (...) the dependence of glass transition temperature on heating rate, the E g has been calculated on the basis of the Kissinger [Anal. Chem. 29 (1957) p.1702] and Moynihan [J. Phys. Chem. 78 (1974) p.267] models. Thermal stability has been monitored through the calculation of temperature differences T c–T g, the stability parameter S, and the enthalpy released during crystallization H c. The GFA has been investigated on the basis of the Hruby parameter H r, which is strong indicator of GFA. Results for GFA are in good agreement with fragility index F i calculations, indicating that Se90In6Sb4 is an excellent glass-former. (shrink)

In developing the metaethical foundation for the Land Ethic, J. Baird Callicott has relied on the cognitive plasticity and directionality of the moral sentiments in order to argue for an extension of those sentiments to the environment. As he sees it, reason plays a substantial role in determining which objects we direct those sentiments toward, and ecology has now shown to reason’s satisfaction that we are part of larger, land communities. In this essay, I would like to develop the claim (...) that we should be careful not to overemphasize the cognitive nature of the “moral sentiments” at the expense of their biological basis as an ecologicaladaptation. I hope to show that this is of special importance for the Land Ethic, where the metaethic involved is entirely dependent on a “felt” sense of community to generate the extension of moral consideration to the environment. The first three volumes of the Minnesota Studies have become recent classics. They contain some of the most important and philosophically suggestive papers published during the fifties and early sixties. Some of the discussions which are the basis of volume IV took place in 1966 and a number of the papers here seem "dated"--at least to the extent that discussion of the relevant issues has been superseded by publication in other places. There is still another tour de force by Paul (...) K. Feyerabend, who is becoming more strident and more anarchistic in his politics, epistemology, and philosophy of science. There is a brief paper by the late N. R. Hanson and a typically solid and balanced defense of the "standard conception" of scientific theories by Carl G. Hempel. Three papers by Paul E. Meehl are included which, as usual, excel in the care and clarity of argument--even though there seems to be little that is new here. And there is also an informed discussion of correspondence rules by a number of participants in a special conference dedicated to this subject. While the quality of the papers is high, this volume nevertheless lacks some of the excitement and novelty of the earlier volumes.--R. J. B. (shrink)

The formulae advanced by Popper to calculate the degree of corroboration C of a scientific hypothesis are unsatisfactory in that the probability values required in the computation are often not available. An attempt is made to define a quantitative measure B* in the place of C in which only countable empirical values would be used. This condition is fulfilled in two basic formulae and eq. ), which could be applied to calculate the degree of corroboration. When m successful falsifications of (...) the hypothesis h appear after a sequence of n unsuccessful ones, the pragmatic degree of corroboration B* results from the difference between B and the analogue value of the falsification F* and eq. ). In the event that the hypothesis can be "rescued" through a correction, increased experimental effort must be made with the revision. This would be taken into account through the correction equation ). When the hypothesis cannot be corrected, however, it can no longer exceed the value of 1-F*, even after numerous verification experiments. In the process of deciding whether a hypothesis is "adequately" verified or falsified, a lower threshold ${\rm B}_{{\rm u}}$ und Bₒ must be selected. These values have to be chosen on an intuitive subjective basis. The same applies to the strength of unsuccessful falsifications . This evaluation is expressed by a multiplicative constant a̱ ) or an additive constant kₐ in eq. . Despite the subjectivity of the values a̱, kₐ necessary for the calculation of B*, and of the values ${\rm B}_{{\rm u}}$ , Bₒ for the decision to discontiue the examination of the hypothesis, I feel that amongst the scientists within a particular field of research, a consensus for these values should be possible. Through a quantitative determination of B* the procedure for testing a hypothesis, considered to be a closed loop process, becomes clearer. To estimate the values of B* could not only have an influence upon the decisions of the respective researchers or research groups examining a hypothesis, but also be of assistance in decisions regarding research grants when financial resources are limited. Mozley charts the development of the doctrine from the Apostolic Fathers through the Reformation to the modern influence of metaphysical philosophy and concludes with six questions intended to prompt further theological discussion on this point. This book will be of value to anyone with an interest in the history of Christian theology.

Recent scholarship on technology-induced ‘conceptual disruption’ has spotlighted the notion of a conceptual gap. Conceptual gaps have also been discussed in scholarship on epistemic injustice, yet up until now these bodies of work have remained disconnected. This article shows that ‘gaps’ of interest to both bodies of literature are closely related, and argues that a joint examination of conceptual disruption and epistemic injustice is fruitful for both fields. I argue that hermeneutical marginalization—a skewed division of hermeneutical resources, which serves to (...) diminish the experiences of marginalized folk—does not only transpire because of conceptual gaps, but also because of two other kinds of conceptual disruption: conceptual overlaps and conceptual misalignments. Hence, there are multiple kinds of conceptual disruption that can be usefully studied through the normative lens of epistemic injustice. Technology can play different roles vis-a-vis epistemic injustices, both as a causal trigger of conceptual disruption, but also as a mediator of hermeneutical resources. Its role is normatively significant, in particular because socially disruptive technologies can have different epistemic implications for different groups: they may amplify the epistemic resources of some groups, while diminishing those of others. This article revisits long-standing questions about consent, membership and emigration in Locke’s thought. Commentators such as A John Simmons have argued that Locke opens political membership to both express consenters and some kind of tacit consenters, and not just to the former, as some have suggested. Simmons’s reading seems to render Locke more sensible in that it does not exclude large numbers of people from membership or burden the few members with all the civic duties, and also in that it (...) allows at least tacit-consenting members the right to relocate, while this right is denied to express-consenting members. Against this reading, the article shows, by resolving seemingly conflicting claims in the text, that people become members only by express consent. It also responds to the criticism that the express-consent-only reading would limit membership to a few and so would render Locke’s account implausible from a practical point of view. The article then addresses the purported restriction Locke imposes on express consenters’ right to emigrate, arguing that the restriction concerns the change of membership and not the right to relocate. The advent of personal genomics companies offering direct translation of scientific data into personal health information, calls into question traditional policies to refuse disclosure of such scientific data to research participants. This seems especially true for population biobanks, as they collect not only genotype information but also associated phenotype information, and thus may be in a unique position to translate their scientific findings into personal health information for their participants. Disclosure of such information seems mandated by the expectations raised by (...) biobanks and their participants' rights to know health information, to know clinical research results, to life and health and particularly their right to benefit. Refusals to disclose such information can be grounded in the lack of analytical validity and/or clinical utility of most findings, the need to avoid the therapeutic misconception, the complexity and costs involved in translation and disclosure and the disproportionate burden resulting from the obligation to respect participants' right not to know before any disclosure can be made. Currently, any demands by participants in population biobanks for full disclosure of all pertinent personal health information potentially resulting from the biobank's scientific findings are unlikely to be granted by a Dutch court under Dutch and international law. As the law stands now, a population biobank is neither a doctor nor a personal genomics company. However, in view of the rapid scientific, medical, technological, commercial and social developments, population biobanks must prepare to take more care of their participants' legitimate interest in receiving as much validated personal health information as reasonably possible, in a timely fashion, by developing appropriate translation and disclosure mechanisms. This paper examines whether population biobank participants have the right, under Dutch civil law and international law, to full disclosure, i.e. to all information generated by the biobank that is pertinent to their present and future health. It pioneers the format of a hypothetical court case to elucidate the legal and policy arguments" for and against full disclosure. (shrink)

The current UN policy regarding free speech presents a philosophical dilemma between accepting the free speech provisions in the Universal Declaration of Human Rights and exceptions carved out for hatred, hostility, and religious defamation. The Declaration should be understood to imply viewpoint neutrality and the exceptions for defamation are not viewpoint neutral. If the UN were to adopt J. S. Mill’s crucial distinctions between expression and performative speech, content and context, and mental states and the acts motivated by them, it (...) would be clear that hatred, hostility, and defamation cannot be exceptions to viewpoint neutral free speech. If the heart of free speech is freedom especially for the thought we hate, then the UN should abandon its exceptions or abandon appeals to free speech. However, I will offer a strong reason that it should not do the latter. (shrink)
